Canada Rent A Car is part of the U.S. Rent A Car Group.
All bookings by our customers are subject to our terms and conditions.
The customer acknowledges that in making a booking with U.S. Rent A Car Ltd / Canada Rent A Car he/she does so only on the basis of the material contained in our brochure, voucher, on our website or information provided on the phone by its employees.
The cost and conditions of all insurances and items are subject to change without prior notice and subject to local tax U.S. Rent A Car Ltd / Canada Rent A Car cannot be held responsible for changes outside of its control.
U.S. Rent A Car Ltd / Canada Rent A Car acts as a car rental broker and agent for various independent rental companies in the USA Bookings made through U.S. Rent A Car Ltd / Canada Rent A Car are subject to these terms and conditions. Please note that the rental of the vehicle will be subject to the law of the country in which it is supplied to you and for this reason you will be required to sign a rental contract with the rental company, which supplies the vehicle. You should satisfy yourself that you understand (and agree) to its terms and conditions, as you will be subject to, and must comply with these terms, and the local law.Once you sign the rental agreement with the local car hire company your contract is with that local company. Any disputes arising from this agreement must be pursued directly with the rental company.
U.S. Rent A Car Ltd / Canada Rent A Car works in conjunction with other car rental companies based in the UK that act as sales agents for car rental companies that provided the bookable services on our website. In the event of loss or financial failure of these associated companies U.S. Rent A Car Ltd / Canada Rent A Car reserves the right to switch your rental to an alternative supplier, amend your reservation to the nearest 'similar' sized available vehicle or switch collection and drop off locations to the nearest possible available alternative or cancel your reservation without prejudice should no alternatives be available.
Reservations made outside office working hours: When you make a reservation with U.S. Rent A Car Ltd / Canada Rent A Car your 'request' is not confirmed until your reservation has been confirmed by the appropriate supplier chosen. Should your reservation request be made at a time when our office is closed your reservation may not be confirmed in time. If your reservation request is not confirmed in time you will not be charged. Please note: A reservation request is not a confirmed booking. Your booking is only confirmed once your payment method has been processed and your rental voucher has been issued.
U.S. Rent A Car Ltd / Canada Rent A Car cannot accept liability for any charges incurred on documentation signed for and accepted locally.
U.S. Rent A Car Ltd / Canada Rent A Car will not be held responsible for anyone driving under the influence of alcohol/drugs, causing willful damage, off road driving or driving without due care and attention. The customer will accept responsibility in respect of such claims. This list is not exclusive.
U.S. Rent A Car Ltd / Canada Rent A Car cannot be held responsible for clients failure to collect any prepaid reservation regardless of reason. This list is not exclusive.
Cars and all offers are subject to availability. All information in these terms and conditions, including prices, is correct at the time of publication.
All Canada Rent A Car.co.uk rental
rates include:
Unlimited Mileage. On all locations except the following;
Capped Mileage: For Rentals Commencing in;
Jasper include 100 Free Kilometers per day/700 Free Kilometers
per week
Whitehorse & Brockville include 200 Free Kilometers per
day/1400 Free Kilometers per week
London include 300 Free Kilometers per day/2100 Free
Kilometers per week
Mileage charged at around 0.28CAC per mile thereafter. Please check with the supplier upon collection of the vehicle. CanadaRentaCar.co.uk are not responsible for these local charges and will not be responsible for fluctuation in prices.
Loss Damage Waiver (LDW) which is a combination insurance of
both Collision Damage Waiver (CDW) and Theft Waiver. As long
as you adhere to the rental policy of the supplier you will
only be responsible for the first $500.00 if aged 21-24, or
$300.00 if 25 and above for the cost of replacement or repair
to your hire vehicle.
Uninsured Motorist Protection (UMP) up to $1m Liability Cover.
Offers an Uninsured/Underinsured/Hit-and-Run Motorist Protection
(UMP) that provides the renter and family members travelling
together in the rented vehicle with up to $1,000,000 of non-stacked
coverage for bodily injury sustained while driving the rental
car, and caused by another driver who has no insurance, minimal
insurance, or is a hit-and-run driver.
Supplemental Liability Insurance (SLI) up to $1m Liability Cover.
All drivers included on the rental agreement will not be held
liable for third party claims for bodily injury or property
damage resulting from an accident.
All Taxes and Airport Fees.
If the Gold Rate is purchased this will include your first tank
of petrol and extend the insurance to accommodate additional
drivers.
Alamo Gold covers up to three additional drivers.
What’s not included?
- One-way rental charges where applicable.
- Young drivers charges where applicable.
- Garaging, tolls, congestion charges, parking and traffic fines.

Collision damage waiver and loss damage
waiver covers you for damage in the event of an accident
unless the accident is caused by your negligence, you are
under the influence of drink or drugs, you are using the
vehicle in a prohibited way or your licence is invalid or
invalidated or, indeed acting in any manner which invalidates
cover. In addition, if you commit a driving offence or are
deemed to be at fault by the provider of the hire vehicle,
the provider may refuse to provide you with a replacement
vehicle. In such an event, no refund will fall due to you.
Please note that windscreens, tyres, and towing charges
may not be covered under the inclusive policy. However, an optional
extra protection insurance is offered to waiver liability by
some providers. Additional insurance may be required if the
vehicle is to be used across borders (Items paid locally may
be subject to tax).
Insurances excesses vary according to supplier and vehicle selected. Typically between $300CAD and $500CAD. Please refer to your rental voucher for charges. An excess waiver may be offered locally by the supplier. Please ask at the time of collection.
PLEASE NOTE: Calgary & Montreal Airports will be subject to an airport tax of $4CAD per day.
Rates and charges
Rates are based on the currency exchange rates prevailing at
the time of quotation/booking. We reserve the right to increase
the cost of the booking as a result of adverse currency fluctuation
but, in the unlikely event that we do wish to increase the price,
you may cancel the booking within 48 hours of being advised
of the change, without charge and, receive a full refund of
monies paid by you. In the unfortunate event of inaccuracy in
the price at the time of booking, we will advise you of the
correct price and, if that price is not acceptable to you, the
booking will be cancelled at no charge.
Payment Methods
Payment for reservations can be made in the following ways,
Visa, Visa Delta, MasterCard or Switch. We also accept cheques.
If paying by cheque there must be at least 21days before the
hire is due to start. Please make cheques payable to Canada
Rent A Car Ltd and send them to PO Box 304, Aldershot, GU12
4WU. Please note you’re booking reference number on the
back of the cheque. On receipt of your cheque a member of our
reservations team will contact you to confirm its arrival.
Flight information
For airport pick-ups, it is essential that Canada Rent A Car.co.uk
be given the correct flight number and arrival time, before
departure. This can be done either online or by phone.
If this is not available at the time of booking, please ensure
that you inform us of this at least 7 days prior to departure,
either online or by phone. No responsibility can be accepted
or compensation allowed for a failed rental due to the late
provision of this information.
Driver’s age
Canada Rent A Car.co.uk deals with many suppliers in Canada,
the general rule states that drivers between the ages of 21
to 24 will be levied with a young driver’s surcharge of
CA$20-$25 per day, per driver plus tax. Our suppliers do not
have an upper-age limited but can refuse to hire a vehicle if
the customer is not fit to drive.
Vehicle Availability
Most vehicles are available on a 24 hour free sale basis. Specialist
vehicles such as 4x4's, luxury, Premium, Convertibles, 7,8,12
& 15 seater Minivans are all on a 48 hour request basis
with our suppliers. Please note that your credit card will not
be charged until your booking has been confirmed. Should your
requested vehicle not be available, we will contact you via
email or by any contact number provided.
Cancellation administration charge
Canada Rent A Car.co.uk will levy a charge for cancellation
of any booking you are unable to honour prior to your collection
date (see below). Unless cancelled within the first 48 hours
of booking (cooling off period)
No refunds will be given for rentals ended early, late collections,
no shows or cancellations made after the rental start date.
All cancellations must be made in writing, emailed to info@canadarentacar.co.uk
or faxed to 0845 226 8524 (and vouchers returned) and will take
effect from the date received by Canada Rent A Car.co.uk.
Cancellation charges
7 or more days before start date £50.00
6-4 days before start date 50%
3-1 days before start date 75%
24 Hours before start date 100%
Vouchers must be returned as soon as possible and be received
by us before the date on which they could be used otherwise
no refund of any pre-payment will be made.
Amendment charges
A charge of £15.00GBP may apply in the event of any amendment
of any confirmed reservation.
Period of rental
Rental days are based on 24-hour units, commencing at the time
of pick-up. If you wish to extend the rental period after collection
of the car, or if you return the car late, you will be charged
locally at the local daily rate, which may be higher than our
rates. No refunds are payable on cars returned early.
Special requests
Child seats: these are mandatory in most countries
and must be requested at the time of booking. Although instructions
will be provided you will be required to fit the child seat
yourself. The cost for these will depend on which supplier you choose and all seats will be charged on a daily basis.Please confirm the price upon collection of the vehicle as U.S. Rent A Car / Canada Rent A Car will not be responsible for variations in price. For older children, it is recommended that you take
your own booster seats.
Snow tyres/Chains and Ski Racks: these are available
in some locations and should be specially requested at the time
of booking. There is usually a charge for them which is payable
locally. No guarantee can be made regarding their availability.
Emailed Quotes
Quotes that are received via email are not a guarantee of price
or availability. Prices are subject to change at any time without
notice. Once booked and confirmed your hire price is guaranteed
unless subject to any of the conditions laid out here.
One-way
rentals
One-way rental charges are based on a city-to-city basis and
are always on request. The one-way rental charge shown on this
site are only an example and although they are correct at time
of quoting our supplier retains the right to change this at
anytime without notice. All one-way rental charges are paid
locally and are not permitted on Economy 2dr or 4dr.
One way fees are subject to local taxes.
0 - 200 miles $50.00
201 - 500 miles $100.00
501 - 1000 miles $300.00
Over 1000 miles $500.00
Out of hour’s charges
In most locations flights will be met and cars supplied outside
of normal working hours. However, there may be an additional
charge for this service payable locally. This will be quoted
when your flight timings are given to us. In the event that
a flight is delayed, causing the car pick-up to fall outside
normal working hours, the additional charge will be made locally,
where the out of hours service is available.
Driving licence
Drivers must produce a full driving licence from their Country
of residence (we cannot accept bookings from US or Canadian
driving licence holders), which they have held for at least
one year. UK Drivers with a new style licence must have all
sections with them.
In certain locations and for some car types, drivers must have
held a full licence for a minimum of 2 years.
It is the driver’s responsibility to ensure that he/she
has the appropriate driving licence
Our reservations agent must be informed of any endorsements
that lead to a ban on the driver’s licence, as we may
not be able to take your booking.
No refunds will be given for rentals rejected due to non-production
of a driving licence or non-disclosed endorsements.
Faxed or photocopied licences are not acceptable.
Rental documents
The rental voucher must be presented when picking up your rental
car. Canada Rent A Car.co.uk cannot be held responsible for
rentals rejected if a voucher is not presented.
You should retain your rental documents and related receipts
for a minimum of 28 days after returning home.
Additional drivers
Charges often apply for additional drivers and are payable locally
on pick-up. Canada Rent A Car.co.uk cannot be held responsible
for any increase in charges. Please check online or with our
reservations department at the time of booking.
Local Deposits
Deposits vary by destination but are generally $100.00 per week.
A valid credit card in the name of the lead driver must be produced
upon collection of the car, as a form of deposit.
Cash deposits are rarely accepted.
Local Charges
Local charges for equipment hired directly from the suppliers will be your responsibility. U.S. Rent A Car / Canada Rent A Car will do our best to advise you of any costs but will not be responsible for the accuracy of these costs. Any local charges are subject to change by our supplier without reference to us and may incur local taxes. Please check with the supplier before signing your rental agreement.
Provision of cars
Our local car rental partner can refuse to provide a car to
any customer who is, in their opinion, unfit to drive or does
not meet eligibility requirements. In such circumstances your
contract with us will terminate immediately, and we will have
no further liability to you, and no refund will be due. - Vehicles are supplied by suppliers who, in some cases are franchise operators of a branded rental company that accept bookings under a Pre-Paid Tour Operator Agreement. The supplier reserves the right to withdraw from the 'Tour Operator Agreement' at any time. In this instance your reservation will be cancelled and a full refund will be issued.
Number of passengers
Our rental cars are insured for a maximum number of passengers.
Canada Rent A Car.co.uk cannot accept responsibility if the
vehicle is not large enough to fit all passengers and luggage
on arrival if details were not supplied at the time of booking.
In the interest of safety this number must not be exceeded and
if exceeded the insurance will be invalidated.
Driving restrictions
Restrictions are applicable when crossing country and state
borders. Please consult our reservations department at the time
of booking as to whether border crossing is permitted and what,
if any, charges apply.
Tax
All taxes are included except those on any extras purchased
locally. E.g. One-way drop-off fees, child seats and additional
drivers.
Canada Rent A Car.co.uk reserves the right to levy any government
increases in local taxes that may be introduced after the printing
of these terms and conditions.
Any additional charges payable on arrival are subject to local
taxes at the prevailing rate in that State.
Car type/suitability
Canada Rent A Car.co.uk is unable to guarantee a particular
make, model or fuel type of car. The car shown on your voucher
is for guidance only and may be substituted for an alternative,
similar or upgraded car (at no extra cost).
If it becomes impossible to provide your booked car due to breakdown
or an accident, a similar or upgraded car will be provided.
If you are dissatisfied in any way with the standard of your
booked car, you must advise our local car rental partner immediately
and Canada Rent A Car.co.uk in writing within 28 days of your
return. Failure to do so may result in any claims not being
accepted or settled by Canada Rent A Car.co.uk.
Mechanical difficulties/accidents
In the event of any mechanical difficulties or accidents involving
your car, it is important that details are reported to our local
car rental partner within 24 hours.
In the event of an accident you must also complete an accident
report form by the end of the rental period.
Local police should also be notified in the case of accidents
and a signed police report obtained.
Full details of third parties should also be obtained.
Our local car rental partner must give authority to repair or
replace a vehicle. Their name and contact details are shown
on your voucher and rental agreement.
You should retain copies of all rental documentation in the
event an insurance company is involved.
Your insurance cover may be invalidated if this procedure is
not followed correctly and this may prejudice any claim for
compensation.
Complaints
Canada Rent A Car.co.uk aims to resolve complaints within 28
days of receipt. In doing so a situation may arise where customers
or travel agents receive a refund, goodwill gesture and/or compensation
payment of a duplicated nature, from both Canada Rent A Car.co.uk
and our local car rental partner. In such an event Canada Rent
A Car.co.uk reserves the right to recover such duplicated payments
at any time within two calendar years of such an event. Some
complaints may take longer than 28 days owing to the nature
of the issue and information provided. Canada Rent A Car.co.uk
can only consider complaints that reach them within 180 days
of the final day of rental to which the rental voucher refers.
Actions against Canada Rent A Car.co.uk are restricted to the
laws that occur within the jurisdiction of the United Kingdom
courts.

Consequential loss
Canada Rent A Car.co.uk are responsible for
losses you suffer as a result of Canada Rent A Car.co.uk breaking
this agreement, if the losses are a foreseeable consequence
of Canada Rent A Car.co.uk breaking the agreement. Losses are
foreseeable where both you and Canada Rent A Car.co.uk could
contemplate them at the time our agreement is formed. Canada
Rent A Car.co.uk is not responsible for indirect losses which
happen as a side effect of the main loss or damage and which
are not foreseeable by you and Canada Rent A Car.co.uk (such
as loss of profits or loss of opportunity).
Force majeure
Canada
Rent A Car.co.uk shall not be liable itself or vicariously through
its local car rental suppliers for either a failure to perform
or delay in performing any of its obligations under or pursuant
to this booking, voucher, reservation, rental or terms and conditions,
if and in so far as performance is delayed, hindered or prevented
by force majeure, which expression shall mean any event beyond
the reasonable control of the party in question. In the event
that the force majeure persists for more than 14 consecutive
days, Canada Rent A Car.co.uk may terminate and withdraw this
booking, reservation or rental by giving 14 days notice to the
client’s original billing address.

Sat Nav Rental
General
In these Terms & Conditions of Hire the following words shall have the following meanings: -
"OWNER" U.S. Rent A Car Ltd t/a Rent A Sat Nav.com registered office 92 Park Street, Camberely, Surrey, Surrey, GU15 3NY
"HIRER" Means the Hirer of the Equipment
"EQUIPMENT" Means those products or Equipment itemised on the Rental Quotation or Delivery Note and these Terms & Conditions shall apply to the agreement under which the Equipment is to be supplied for rental
Agreement and Ownership
This Agreement is a Rental Agreement; under its terms the Owner rents the Equipment to you for the purposes of your business. The Equipment does not become yours and you must not sell it.
Your obligation
You shall:

The Owner shall provide preventative
maintenance in accordance with the Contract on a scheduled
basis agreed with the Hirer and remedial maintenance to
return the Equipment to a satisfactory operating condition
when required. Neither the Hirer's personnel nor any third
party employed by the Hirer shall provide any part of the
maintenance service without the prior agreement of the Owner,
which shall not be unreasonably withheld.

Not modify the Equipment. The Owner reserves
the right to charge you for remedying any damage resulting
from use otherwise than in accordance with the manufacturer's
instructions.

Keep the Equipment safe at all times
and remove it from its mounting when the vehicle is unattended.
-
It is your responsibility to insure the
Equipment against all risks for the value of the Equipment,
which is £600.00.
-
Not sell, assign, let on hire or otherwise
dispose of part with possession of the Equipment or assign
or charge the benefit of this agreement.
-
Acknowledge that payments sent through
the post will be at your own risk.
-
Pay the rental and advance payment (where
applicable) on the due dates. Failure to remit payment constitutes
a repudiatory breach, time being of the essence for each
and every payment due.
Liability
- The Equipment is at your risk.
-
The Owner hereby warrants to the Hirer
that each item of Equipment, when delivered, will be in
fully serviceable condition and complies with the manufacturer's
proper specification.
-
The Owners liability hereunder will in
no circumstances exceed a sum equivalent to the total rentals
received by the Owner. The foregoing warranty and damages
for breach thereof are the exclusive warranty and damages
for breach thereof are in lieu of any oral representation
and all other warranties and damages whether implied or
statutory. The Owner does not warrant the merchantability
of the Equipment or its fitness or suitability for any particular
purpose or use. The Hirer should be solely responsible and
hold the Owners fully indemnified against any loss damage
or injury (including death) to persons or property occurring
in connection with any of the said Equipment or as a result
of the use thereof.

The Owner accepts no liability in contract
or tort for any loss, injury or damage, (including consequential
or financial loss) sustained by reason of latent, apparent
or patent defects in the Equipment, parts or consumables,
or late, or non delivery. This does not apply to death or
personal injury as a direct result of the Owner's negligence.

Notification of a defect to the Owner
does not in itself give you the right to vary or terminate
this agreement, but if the Owner does not receive such notice
from you within 2 days of the acceptance date, then it will
be presumed that the Equipment is complete in good working
order and condition and fit for all purposes for which it
may be required.

You acknowledge that the Owner is not
responsible for any loss damage or expense resulting from
delay in the delivery or installation of the Equipment.
Period of Hire
The
period of hire will be agreed at the outset. The term of hire
will be for a minimum of one week which is 7 days and daily
thereafter.
Deposit
The Hirer will be required to leave a PreAuth security deposit
of £250.00, which will be held on a credit or debit card.
A PreAuth transaction obtains authorisation from the authoriser
for the amount of the deposit. In the first step (the PreAuth)
the funds are reserved (subtracted from the customer's open-to-buy
balance); however the customer is not charged until a PostAuth
transaction is submitted.
No funds are transferred during a PreAuth. Funds are transferred
if the equipment is not returned.
Commencement and End of Hire
Hire commences on the day the Equipment is delivered, to the
Hirer's advised delivery point. End of hire is the day the unit
is handed to the post office for guaranteed next day by 1pm
service. Late returns are payable at £10.00 a day.
Operation Conditions
Unless notified in by the Hirer within twenty four hours after
the delivery has been affected it shall be conclusively presumed
that the Equipment was received in a fully serviceable condition
and in complete accordance with the customer's order and manufacturer's
description. The Hirer shall ensure that the Equipment is in
fully serviceable condition and suitable for use at any site
on which the Equipment is situated.
Transportation
Within your rental cost includes delivery to and from your chosen
address. It is your responsibility to collect (where applicable)
and return the equipment. Charges will apply as outlined.
Damage or Loss of Equipment and Packaging
The Hirer will in its use of the said Equipment and Packaging
observe all the instructions that may be issued for the proper
use thereof and shall be entirely responsible for any damage
caused to the said Equipment through failure to observe such
instructions or failure to use the same in a proper manner.
The Hirer will be responsible for the replacement cost of any
damaged or lost components of the unit or any repair. The Owner
accepts no responsibility or liability for any damage to or
failure of operation of the Equipment due to any incompatibility
with any other Equipment used by the Hirer and the Hirer shall
bear all liability thereof.
Packaging
Our packaging is specifically designed to insure safe delivery
of our GPS systems. All equipment should be returned as you
receive it. If the packaging is damaged in anyway or lost you
will incur a charge of £15.00. This charge is to cover
the replacement of said packaging.
Non Return of Equipment
The Hirer will be responsible for the safe return of the unit
and all its component parts. The Hirer will be responsible for
hire cost until such time as the unit and/or any missing components
are returned at the rate of £10.00 a day.
Cancellation
We will levy a charge for cancellation of any booking you are
unable to honour prior to your collection date. Unless cancelled
within the first 48 hours of booking (cooling off period).
Cancellations charges are as follows.
7+ days = £25.00
7-3 days = 50%
2-0 days = 100%
No refunds will be given for rentals ended early or cancellations
made after the rental start date.
All cancellations must be made in writing, emailed to info@rentasatnav.com
and will take effect from the date received by us.
Notices
Notice under the terms of this agreement shall mean any notice,
letter or demand in writing. Notices may be given by either
party to the other by posting the same in the ordinary second
class mail to the address of the other party as advised by them
or to such other address as may previously have been advised
in writing. Any notice shall be deemed to have been received
three days after posting to the address supplied or advised.
If the Hirer consists of more than one person, a notice, letter
or demand posted to one of them at the address supplied will
be deemed to have been received by each of them three days after
posting.
Consumer Credit Act
If the Hirer is a body corporate or a registered Charity or
if the total of the payments which it is required to make under
this agreement exceeds £15,001 including VAT, then this
agreement is not regulated by the Consumer Credit Act 1974 and
any statement herein or any copy hereof to that effect and the
consequences of regulation are inapplicable.
Joint Renters
Where two or more of you are parties to this agreement as Hirers
your liabilities hereunder shall be joint and several.
Entire Agreement
The Owner hires the Equipment to you upon these Terms and the
Conditions which represent the entire agreement between you
and the Owner. Any variation to the Terms and Conditions shall
not bind the Owner unless the same is confirmed in writing and
signed by a Director of the Owner. Any failure by the Owner
to enforce the terms of this agreement at any time or other
indulgence granted to the Hirer shall not operate as a waive
as the rights of the Owner.
Software

The following shall apply where software
is supplied with the Equipment :-

The title to all software including programs
and documentation furnished by the Owner shall be retained
by the original manufacturer.

The Hirer is supplied the use of the
software only for the rental term and the software should
be used only on the specific Equipment with which it was
supplied. Use of the software shall consist either of copying
any portion of the program from storage units or media into
the CPU or the processing of DATA with the program or BOTH
The Hirer shall :-

Hold all software in confidence and shall
not disclose it to anyone other than its employees and consultants
who require disclosure in connection with the Hirer's use
of Equipment and who are subject to confidentiality obligations
at least as strict as those set out in these Terms and Conditions.

Not print copy modify translate alter
reverse compile de-compile or reverse engineer any software
(save insofar as permitted by statute).

Not remove any copyright trade mark or
other proprietary notice from the software.

Not transfer the software nor assign
any licence or rights regarding the software and any such
attempted transfer or assignment shall be void and of no
force or effect.

Subject to the provisions the Hirer shall
not copy or duplicate or permit a third party to copy or
duplicate in any manner any physical or magnetic version
of the Owners supplied machine readable software. The Hirer
shall not copy or duplicate any printed materials related
to any furnished with the Owners supplied machine readable
software.

Upon termination of the hire in accordance,
the Hirer shall return to the Owner the original Owners
supplied machine readable software all copies thereof and
all printed materials furnished with such software.

The provisions of the above shall
not apply if the Hirer has purchased user rights from the
Owners for the Owners supplied software and assigned the
original manufacturers software or program licence agreement
for the said software. In that event the Hirers rights and
obligations upon termination shall be governed by the original
manufacturers software or program licence agreement.

No licences or rights are granted except
as set forth herein or in the original manufacturers software
or program licence agreement which the Hirer shall be required
to sign on receipt and before using the software. The software
may not be assigned without the Owners prior written consent.

The obligations in respect of software
set out in these Terms and Conditions shall survive notwithstanding
any termination or expiration of an agreement for the hire
of any Equipment and if the Hirer commits any breach of
obligations placed on it by the Terms and Conditions the
Owner may in addition to any other legal or equitable remedies
available to it immediately terminate the relevant hire
agreement.
Force Majeure
The
Owner accepts no liability for delay or non-fulfilment of any
terms of any order by a Hirer caused wholly or in part by force
majeure which express shall be deemed to include war, strikes,
lock outs, accidents, fire, scarcity of materials or any other
cause or causes not within the Owners direct control.
Hirers Liability Under The Incorporated Authorisation Agreement Provisions
The Hirer shall indemnify and keep indemnified and hold harmless the Owner against and from :-

Any breach non-observance or non-performance
by the Hirer his employees servants or agents of the said
provisions of the Authorisation Agreement or any of them
and
-
Any act omission or default of the Hirer
his employees servants or agents which involves the Owner
in any liability to and
-
Any claim damage loss or expense due
to or resulting from any negligence or breach of duty on
the part of the Hirer his employees servants or agents.

In the event of any breach non-observance
or non-performance by the Hirer of the said provisions of
the Authorisation Agreement the Owner shall have the same
rights in all respects against the Hirer.
Governing Law
This
agreement shall be governed by the Law of England. Both parties
submit to the non-exclusive jurisdiction of the English Courts.
